When your statutory WorkCover claim comes to an end, you are entitled to receive from the workers’ compensation insurer a document called a Notice of Assessment.
Before a Notice of Assessment issues, WorkCover (or the self-insurer) will arrange for you to attend a doctor or the Medical Assessment Tribunal to obtain a report confirming your injuries are stable and stationary, and allocating a percentage permanent bodily impairment.
The insurer will then email or mail the Notice of Assessment to you. If you have a lawyer you should pass the Notice on to your lawyer as soon as possible. If you do not have a lawyer, you can seek legal advice regarding the Notice before making a decision.
The Notice of Assessment will set out your injuries, permanent impairment from the injuries, and may include a lump sum offer of money. You should seek legal advice before making a decision about whether to accept, reject, or defer the lump sum offer – as your decision may impact whether you are then able to pursue a common law claim for damages.
