If you suffer a personal injury in Queensland you will no doubt spend money on medical treatment, rehabilitation, medication, travelling and other items. In your claim, these expenses are known as ‘special damages’.
It is important that you keep a record of all of your out of pocket expenses. The best way to do this is to keep a diary listing the amounts you spend and keeping the tax invoices and receipts to support this. Some of the amounts may be small but over the curse of your claim, your out of pocket expenses may add up.
It is important though, that your out of pocket expenses are reasonable and appropriate. Some out of pocket expenses may be rejected by the insurer. If you have any doubt you should ask your lawyer.
When it comes time to settle your claim your lawyer will detail all of your claim to the insurer including your out of pocket expenses. Interest can also be claimed on certain expenses.
